Dealing with Claims Agents

After an injury, your medical treatment is supervised by the Chief Medical Officer, your case is investigated by the Claims Department, the Operations Department gives railroad lawyers access to witnesses, the Superintendent’s Office compels the witnesses to cooperate and the Legal Department sets the railroad’s overall strategy.

The longer you are in a claim agent’s hands, the more opportunity the railroad is given for building a defense. As time goes by, memories of witnesses fade, conditions of the yard and equipment change, and photographic opportunities diminish.

The "nurse consultant" is a railroad employee with full allegiance to the railroad and none to you. You are contacted often and insistently by the nurse consultant and you begin to realize that a team of specialists is working as a unit. You must have asked the question "Are they working for me or against me?"
