 Outline of the Law in FELA Cases

As you may already know, railroad workers who are injured on the job are not entitled to any workers’ compensation benefits for their injuries. Instead, all railroad workers are covered by the Federal Employers’ Liability Act, or FELA, which provides that an injured worker may recover money damages from the railroad for such things as medical expenses, lost wages, loss of future earning capacity, and the pain and suffering associated with his injuries.

Unlike workers’ compensation laws covering other types of workers, however, the FELA requires the injured railroad employee to prove that the railroad was at fault, in whole or in part, in causing the injuries. In addition, if the railroad can prove that the injured employee was at fault in any manner in causing his own injuries, his recovery can be reduced.
